Terms of Sale
Introduction
These terms govern the purchase of transport services (e.g., taxi rides) over the Internet. Consumer purchases of services are regulated by the Contract Act, Consumer Services Act, Marketing Act, Right of Withdrawal Act, and the E-Commerce Act, among others. These laws grant the consumer non-derogable rights and can be found at www.lovdata.no. The terms of this agreement do not limit the buyer's rights under the law but provide an overview of the parties' rights and obligations.
Agreement
The agreement consists of these terms and conditions, the information provided in the booking solution, and any special terms agreed upon directly. In case of conflict, the specifically agreed terms take precedence, as long as they do not violate non-derogable legislation.
Parties
The seller is Traveller Taxi Yttergård, Skolegata 6, firmapost@lofot-taxi.no, phone: 47808111, org. no.: 992069554, hereinafter referred to as "the transporter."
The buyer is the consumer who orders the transport service, hereinafter referred to as "the customer."
Price
The stated price for the transport service is the total amount the customer must pay. The price includes all taxes and additional costs. Any costs not informed in advance shall not be charged to the customer. VAT at 12% is included in the prices stated/paid.
Conclusion of Agreement
A binding agreement is considered concluded when the customer has completed the booking of the transport service.
If there are typographical errors or technical mistakes in pricing or other information that the customer should have understood as incorrect, the agreement is not binding.
Payment
The transporter may require payment when booking or after the service has been delivered.
When paying by card, the amount can be reserved at the time of booking. The card will be charged according to the chosen payment method.
For invoicing, the payment deadline is a minimum of 7 days. Customers under 18 years old cannot pay by invoice with deferred payment.
Delivery of Service
The service is considered delivered when the transport has been carried out according to the booking, i.e., the customer has been transported to the agreed destination.
The transporter shall arrive at the agreed time and place. In case of delays, the customer shall be informed as soon as possible.
Transfer of Risk
The risk that the service cannot be delivered is transferred to the customer once the transport has begun. This includes situations caused by the customer's absence or lack of cooperation.
Right of Withdrawal
The Right of Withdrawal Act generally does not grant a right to cancel transport services agreed upon for a specific time. This also applies to taxi services booked for a specific time.
If the right of withdrawal is applicable, the customer must notify in writing no later than 14 days after the booking. If the transport has already begun, the right of withdrawal is forfeited. If canceled within 14 days before the transport date, a cancellation fee of up to 20% may be charged.
Delay or Non-delivery
If the transporter fails to arrive at the agreed time and place without a reasonable cause, the customer may demand a refund, price reduction, or cancel the agreement.
In the case of significant delays or failure to provide the service, the customer is entitled to a refund and possibly compensation for documented expenses resulting from the delay, unless it is due to circumstances beyond the transporter's control.
Defects in Service
If the service has not been delivered according to the agreement (e.g., wrong route, poor driver behavior, unsafe driving), the customer may demand a price reduction or compensation.
Complaints must be made within a reasonable time after discovering the fault. It is recommended to file a complaint in writing.
Customer's Breach of Contract
If the customer fails to show up at the agreed time and place without informing the transporter, the transporter may demand payment for the service as if it had been delivered or a reasonable fee for wasted time.
The transporter may also demand a fee or compensation if the customer cancels too late or otherwise breaches the agreement.
Warranty
The transporter generally does not offer a warranty, but the customer has rights under the applicable laws if the service is not delivered according to the agreement.
Personal Data
The transporter is the data controller for the customer's personal data and processes it in accordance with applicable data protection legislation. The information will be used solely to deliver the service and will not be stored longer than necessary.
Dispute Resolution
Any complaints should be directed to the transporter. If the parties do not reach an agreement, the customer can contact the Consumer Authority for mediation. Alternatively, complaints can be submitted via the European Commission's complaint portal: http://ec.europa.eu/odr.
